Terms of Use

1. About Zemini and these Terms

These Terms of Use ("Terms") are an agreement between you and Zemini ("we", "us") covering the website at https://zemini.ai and the Zemini mobile app (together, the "Service"). The Service lets you edit, restyle, enhance and animate photos with artificial intelligence. By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

2. Who may use Zemini

You must be at least 18 years old, or the age of majority where you live, and legally able to enter into this agreement. If you use the Service for a company or organisation, you confirm that you have authority to bind it to these Terms.

3. Your account

• You sign in with a Google account. Keep that account secure; everything done through your Zemini account is treated as done by you.
• One person, one account. Accounts may not be shared, sold or transferred.
• Tell us promptly at support [at] zemini.ai if you suspect someone else is using your account.
• You can delete your account at any time from Settings or from the deletion page linked in the app. Deletion is permanent.

4. What you may and may not create

You are responsible for every photo you upload, every prompt you write and every result you generate or share. Use the Service only for lawful, respectful purposes.

Allowed

• Your own photos, or photos you have permission to edit.
• Creative restyling, enhancement, restoration, background removal, cut-outs and short animations of such photos.
• Personal and commercial use of the results you create, subject to the rights of anyone shown in them.

Not allowed

• Photos of other people used or altered without their consent, including public figures placed in fabricated situations.
• Nudity, sexual or pornographic content of any kind, whether uploaded, requested in a prompt or produced as a result.
• Any sexual content involving minors, or content that endangers or exploits children. This is reported to the authorities.
• Face swapping or any attempt to place one person's face onto another person's body or video. The Service does not offer this and attempts are blocked.
• Content designed to deceive: fake evidence, fake news imagery, impersonation, fraud.
• Hateful, harassing, violent, defamatory or otherwise abusive content, and anything that violates a law or a third party's rights.
• Circumventing usage limits, scraping, automated access, reverse engineering, or interfering with the Service.

Prompts are screened by an automated text classifier and every upload and result is screened by an automated image-safety classifier before it is shown. Blocked content is never delivered. Accounts that repeatedly attempt prohibited content may be limited, suspended or closed without refund.

5. Ownership

• Your uploads remain yours. You give us a limited licence to store and process them only to provide the features you request and to operate the Service. The licence ends when the content is deleted.
• Your results: to the extent permitted by law, you own the images and clips the Service generates for you and may use them for any lawful purpose. You confirm that you have the rights needed for every input you provide.
• The Service: the software, models, design, name and logo of Zemini belong to us or our licensors. Nothing in these Terms transfers them to you.
• Feedback you send us may be used to improve the Service without obligation to you.

6. Free use, limits and paid plans

Zemini offers free daily generations. The number of free generations, the tools included and the speed or quality of processing may change over time. We may offer paid plans (for example an "Unlimited" plan billed weekly, monthly or yearly) that remove the daily limit. Prices, taxes and included features are shown before you buy.

7. Payments, renewals, cancellation

• Paid plans are charged in advance through a third-party payment processor or the app store you bought them from. We never hold your full card details.
• Plans renew automatically at the end of each period until you cancel. Cancel from Settings on the website or in the app, or through the app store, before the renewal date to avoid the next charge.
• After cancelling you keep access until the end of the period you already paid for.
• Because the Service delivers digital results immediately, payments are non-refundable except where the law requires otherwise or as described in our Cancellation & Refund Policy.
• Purchases made through the Apple App Store or Google Play are also subject to that store's terms and refund rules.

8. Availability and changes

We work to keep Zemini available but do not guarantee uninterrupted service. AI models, tools and features may be added, changed or withdrawn, and generated results can vary from one run to the next. Where a change materially reduces what a paid plan includes, we will tell you in advance.

9. Third-party services

The Service relies on third parties such as Google (sign-in), cloud hosting and storage providers, AI model providers and payment processors. Their terms apply to their services. We are not responsible for third-party sites or apps linked from Zemini.

10. No warranty

The Service and everything it generates are provided "as is" and "as available". We make no promises that results will be accurate, suitable for a purpose, free of errors or artefacts, or that the Service will be secure or uninterrupted. AI output can be unexpected; review results before you rely on or publish them.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim, or, if you paid nothing, to INR 1,000. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

12. Your responsibility for what you make

You decide what to create and where to share it. You agree to indemnify and hold Zemini, its owners, staff and partners harmless from any claim, loss or expense (including reasonable legal fees) arising from your content, your results, or your breach of these Terms, including any use of another person's likeness without permission.

13. Suspension and termination

We may suspend or close accounts that break these Terms, abuse the Service, create risk for other users or for us, or that a payment provider or law requires us to close. You may stop using the Service and delete your account at any time. Sections 5, 10, 11, 12 and 14 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of India. Before starting any formal proceeding, contact us at support [at] zemini.ai and give us 30 days to resolve the issue. If it is not resolved, the courts of Surat, Gujarat, India have exclusive jurisdiction, unless the law where you live gives you the right to bring a claim locally.

15. Changes to these Terms

We may update these Terms. The effective date at the top will change and, for significant changes, we will notify you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
